Terms and Conditions

Updated 15 October 2026

1. Subject of Agreement

These Terms and Conditions govern the provision of video production services by Digadiorcollective Pty Ltd, directed by Lucy Smith, located at 142 Flinders Lane, Melbourne VIC 3000, to the Client. By requesting a service via our contact form, the Client agrees to these terms.

2. Booking and Reservations

A booking is considered confirmed only after the receipt of the deposit and a signed brief. All appointments are subject to availability. For detailed data handling during the booking process, see our Privacy Policy.

3. Pricing and GST

All prices listed on the Services page are in Australian Dollars (AUD) and include Goods and Services Tax (GST) at the current rate of 10%. If the Client is a registered business, a tax invoice will be provided for GST credit purposes.

4. Deposits and Cancellations

To secure production dates, a deposit of 40% of the total project cost is required. This deposit is non-refundable if the Client cancels the project. Rescheduling is permitted free of charge if requested at least 3 business days prior to the scheduled shoot. Cancellations made within less than 3 days may result in a rescheduling fee.

5. Production Process and Edits

The production workflow follows a strict timeline: a first draft is typically delivered within 7 business days, with the final version delivered within 14 business days. The service includes 2 rounds of edits. Any additional revisions requested after the second round will be billed at the hourly rate specified in our Post-Production service.

6. Payment Terms

For individual clients, full payment is due upon delivery of the final draft. For B2B contracts, payment terms are 14 days from the date of the final invoice. Late payments may incur interest as permitted under Australian law.

7. Intellectual Property and Rights

Upon full payment, the Client is granted a licence to use the final video for the intended purposes. Digadiorcollective Pty Ltd retains the right to use excerpts of the work for its professional portfolio. All music used is either licensed via stock libraries or provided by the Client; the Client is responsible for ensuring they hold the necessary synchronisation rights for third-party music. For more on data usage, refer to the DPA.

8. Liability and Consumer Rights

Our services comply with the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). We provide services with due care and skill. Our liability is limited to the total amount paid for the specific service. All photos used on this website are illustrative.

9. Governing Law and Disputes

These terms are governed by the laws of Victoria, Australia. Any disputes that cannot be resolved through direct communication with Lucy Smith at [email protected] shall be subject to the exclusive jurisdiction of the courts in Melbourne. Complaints regarding privacy may be directed to the Office of the Australian Information Commissioner (OAIC), GPO Box 5288, Sydney NSW 2001.
